(Sub)contractors

Subcontractors are similar to temporary employees. They are hired to do a specific project for a specific period of time. You should have a written contract for any contractor you retain. Refer to the section on Establishing yourself as an Independent Contractor to ensure that you are treating any contractors you bring on consistent with the IRS criteria and not putting yourself at risk of mis-classifying people who really are employees.

The publication "Determination of Employee Work Status for Purposes of Federal Employment Taxes and Income Tax Withholding" SS-8, is available through Social Security by calling 1-800-829-3676.
